LEGAL NOTICE Eastman & Smith LTD, Attorney In the Court of Common Pleas of Lucas County, Ohio, Case No. CI0201902251. Lucas County Land Reutilization Corporation, Plaintiff vs Ergur Private Equity Group, LLC, et al., Defendants Ergur Holdings, LLC, whose last known address is c/o Ergur Private Equity Group, LLC c/o Agents and Corporations, Inc., its statutory agent, 1201 Orange Street, Suite 600, Once Commerce Center, Wilmington, DE 19801; and Long Term Ground Lease Investors, LLC, whose last known address is c/o Ergur Private Equity Group, LLC c/o Agents and Corporations, Inc., its statutory agent, 1201 Orange Street, Suite 600, Once Commerce Center, Wilmington, DE 19801, and whose present address is unknown and cannot by reasonable diligence be ascertained, will take notice that on April 26, 2019, Lucas County Land Reutilization Corporation, Plaintiff, filed its Complaint in the Common Pleas Court of Lucas County, Ohio in Case No. CI0201902251, on the docket of the Court. This action concerns certain real properties located at 520 Madison Avenue, 608 Madison Avenue, 319 N Huron Street, 321 N Huron Street, and 616 Madison Avenue, Toledo, Ohio, commonly known as The Spitzer Building, Fifth Third Center and the Port Lawrence Building (collectively “Properties”), and further described in the Plaintiff’s Complaint. The object and demand is as follows: That each of Ergur Private Equity Group’s transfers, leases and assignments identified in the Complaint with respect to the Properties be set aside in accordance with RC 1336.07; That Ergur Private Equity Group be enjoined from further disposition or encumbering of the Properties; That title to Spitzer Building and Fifth Third Center be quieted in Plaintiff’s favor with respect to Ergur Holdings, LLC’s mortgages; For such remedies as may be available under RC 1336.07 and/or RC 2735.01 et seq.; For its costs, reasonable attorney’s fees and litigation expenses; and For such other relief as the Court deems just and equitable. You are required to answer the Complaint within twenty-eight days after last publication, which shall be published once a week for six (6) consecutive weeks, with the last publication to be made on the 19th day of July, 2019. In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
